Tax Residency vs. Residency Permit in Portugal: Understanding the Key Differences

I often speak with individuals considering moving to Portugal and find themselves confused about tax residency and residency permits. Many assume that obtaining a residence permit automatically makes them tax residents.

I’d like to outline some key differences between these two concepts and how they impact your stay in Portugal—whether you’re moving for work, investment, or simply a better quality of life.

Residency Permit: Your Legal Right to Live in Portugal
A residency permit is an authorization granted by the Portuguese government that allows non-EU citizens to live in Portugal. There are various types of residence permits depending on the purpose of stay, such as D7 Visa, D2 Visa, Golden Visa, and Digital Nomad Visa.

For EU citizens, the process is different. They do not need a visa but they must apply for an EU Certificate of Residency (Certificado de Registo de Cidadão da União Europeia - CRUE).

However, becoming a resident does not necessarily mean becoming a tax resident—that depends on how much time is spent in Portugal.

Tax Residency: Your Obligation to Pay Taxes in Portugal
Tax residency is determined by the Portuguese tax authorities based on specific criteria. You are considered a tax resident in Portugal if:
✔️ You spend more than 183 days in Portugal within 12 months (consecutive or non-consecutive)
✔️ You have a permanent home in Portugal that is considered your habitual residence
✔️ You register as a tax resident with the Portuguese tax authorities (Finanças)

For EU citizens, tax residency is established once they spend more than 183 days in Portugal within a year. For non-EU citizens, holding a residence permit does not automatically make them tax residents—it depends on their stay duration and registration with the tax authorities.

Can You Have a Residency Permit Without Being a Tax Resident?
Yes! Many expats obtain a residency permit but choose to maintain tax residency elsewhere, as long as they do not meet Portugal’s tax residency criteria. This is especially common for individuals who:
🔹 Travel frequently and do not spend more than 183 days in Portugal
🔹 Have stronger economic or family ties in another country
🔹 Hold a Golden Visa, which requires minimal stay requirements.

🔹 Work part-time (20 hours per week) during the job search

I met people with rich family histories, stories of parents and grandparents who lived through the transition of Goa from Portuguese rule to Indian sovereignty. Many of them had one thing in common — they were eligible for Portuguese citizenship through their ancestry... but they didn’t know it.
